User Agreement
YOUR USE OF THE IBBOTSON RISK TOLERANCE QUESTIONNAIRE AND ANY INFORMATION OR SERVICES THAT MAY BE PROVIDED THROUGH OR IN CONJUNCTION WITH IT (COLLECTIVELY, THE “RTQ”) IS SUBJECT TO THE TERMS AND CONDITIONS OF THIS RISK TOLERANCE QUESTIONNAIRE USER AGREEMENT ("AGREEMENT"). BY CLICKING THE <I ACCEPT> BUTTON BELOW, YOU (“YOU”) ACCEPT THAT YOU: (1) HAVE READ AND UNDERSTAND, AND HAVE THE CAPACITY AND AUTHORITY TO ENTER INTO, THIS AGREEMENT; AND (2) ARE BOUND BY ALL OF ITS TERMS AND CONDITIONS. License: Subject to foregoing and to the additional terms of this Agreement, Ibbotson Associates, Inc. (“Ibbotson”) grants You a revocable, non-transferable, non-exclusive limited license to use the RTQ for your own personal, noncommercial, educational use and not for any use on behalf of any third party other than your spouse or immediate family members. For absence of doubt, You may not use the RTQ to service, or otherwise perform work on behalf of, any brokerage, financial services, or related person(s) or their clients. Use: The RTQ is provided to You for your personal educational purposes only. The RTQ is designed to assist You in identifying your general attitude towards investment risk but should never be used as the sole basis for any investment decision. You may use the RTQ to assess your risk profile and download or print hard copies of pages from the RTQ, but only as provided above. Except as otherwise expressly set forth in this Agreement, You may not modify, copy, distribute, disclose, retransmit, sell, publish, broadcast, or circulate the RTQ, the results generated from its use or any portion of any of them (including, but not limited to, any download or printed copies made using the RTQ) without Ibbotson's prior written consent. The RTQ may only be used by citizens or legal residents of the United States or its territories. Ownership: You understand that Ibbotson is providing You with access to the RTQ pursuant to a separate license agreement with Principal Financial Group, Inc. (“Principal”), by which Principal is allowed to post the RTQ to its Web site for your use, as provided herein. You understand and agree that You are granted only revocable license under this Agreement and that ownership of the RTQ remains solely and exclusively with Ibbotson. License Termination: You understand and agree that your license to use the RTQ will terminate on the date that Ibbotson ceases to make the RTQ available to Principal or one or more of its affiliated companies for your use, as provided herein. You further understand and agree that Ibbotson may additionally terminate your license and instruct Principal to cut off your access to the RTQ at any time if Ibbotson determines that You are using the RTQ in a manner not specifically authorized under this Agreement. Neither Ibbotson nor Principal will have any liability to You as a result of any such termination. Limitations of Liability: Your use of the RTQ is solely at your own risk. Neither Ibbotson and its affiliated companies nor Principal and its affiliated companies shall have any liability (whether direct, indirect, incidental, consequential, special, exemplary or the like, including, but not limited to, investment losses or lost profits) to You or any other party arising in any way from your use of, or inability to use, the RTQ. DISCLAIMER OF WARRANTIES: NEITHER IBBOTSON AND ITS AFFILIATED COMPANIES NOR PRINCIPAL AND ITS AFFILIATED COMPANIES GUARANTEE THE ACCURACY, INTEGRITY, COMPLETENESS, OR TIMELINESS OF THE RTQ OR ANY RESULTS GENERATED BY IT. LIKEWISE, IBBOTSON AND ITS AFFILIATED COMPANIES AND PRINCIPAL AND ITS AFFILIATED COMPANIES HEREBY DISCLAIM ALL WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, RELATED TO THE RTQ OR THE RESULTS PROVIDED BY IT, INCLUDING, BUT NOT LIMITED TO (A) ABSENCE OF VIRUSES AND DAMAGING OR DISABLING CODE, (B) NON-INFRINGEMENT, (C) ANY WARRANTIES OR REPRESENTATIONS THAT (I) THE RTQ OR ANY PORTION OF IT WILL BE ERROR-FREE OR THAT ACCESS THERETO WILL BE UNINTERRUPTED, (II) THE RTQ OR ANY PORTION OF IT IS COMPATIBLE WITH ANY PARTICULAR COMPUTER SOFTWARE OR PLATFORM, OR (III) THAT ANY ERRORS OR DEFECTS WILL BE CORRECTABLE OR CORRECTED, OR (D) THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF INFORMATIONAL CONTENT, OR ANY IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. No Advisory Relationship: You understand and agree that the RTQ, including, but not limited to, any illustrations that may be provided by it, does not constitute “investment advice” of any kind or establish any sort of advisory relationship between You and Ibbotson or any of its affiliated companies. You further understand and agree that Ibbotson does not endorse or recommend any financial products that may be used in conjunction with the RTQ. Investment in any security involves risk that, upon redemption, the security may be worth more or less than the original investment. You are strongly encouraged to seek assistance from a financial professional to determine suitable investment options for your risk tolerance and/or obtain each financial product’s prospectus (or its equivalent) prior to investing. Governing Law: This Agreement shall be construed under the laws of the State of Illinois, without reference to its conflict of laws provisions. You agree to the exclusive jurisdictions of the state or federal courts located in Cook County, Illinois, for any claims or action arising in any way with respect to the RTQ or this Agreement. You may access the RTQ by agreeing to the terms and conditions in this Agreement. To agree, click “I Accept” below.
